Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of BoonRisk, a WordPress security posture assessment platform operated by Boon Band ("we," "us," or "our"). By accessing or using BoonRisk, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the service.

You represent that you are over the age of 18. We do not permit those under 18 to use BoonRisk.

2. Service Description

BoonRisk is a vendor-agnostic WordPress site posture platform that provides security, trust, and readiness assessments. The service includes:

  • Free WordPress plugin for local security assessments
  • Optional cloud-based monitoring and reporting features
  • Evidence-based controls verified through public scans, WordPress plugin, and optional add-ons
  • Professional security reports and posture tracking

Important: BoonRisk is an assessment platform, not a security enforcement tool. The service analyzes your WordPress configuration and generates reports but does not modify, block, or enforce changes on your site. All remediation actions are your responsibility.

3. Acceptable Use

You agree to use BoonRisk only for lawful purposes. Specifically:

  • You may only assess WordPress sites you own or for which you have explicit authorization
  • You may not use the service for malicious purposes, unauthorized access, or to assess sites without permission
  • You may not attempt to reverse engineer, decompile, or hack the service
  • You may not use automated tools to overload or disrupt the service
  • You may not republish or resell access to the service without our written permission

4. Intellectual Property

All content, features, and functionality of BoonRisk, including but not limited to text, graphics, logos, and software, are owned by Boon Band or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use BoonRisk for its intended purpose. This license does not include any rights to copy, modify, distribute, or create derivative works from our service.

5. Beta Period and Service Changes

BoonRisk is currently in open beta. During this period:

  • The service is provided free of charge for the initial beta period
  • Features may be added, modified, or removed as we improve the platform
  • We may experience downtime or service interruptions
  • We reserve the right to introduce paid plans in the future, with advance notice to users

6. Disclaimer of Warranties

BoonRisk is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Completeness, accuracy, or reliability of security assessments
  • Uninterrupted or error-free service
  • Detection of all security vulnerabilities or configuration issues

BoonRisk identifies configuration risks and known vulnerabilities but does not guarantee complete security. Security decisions and implementations based on our assessments are your sole responsibility.

7. Limitation of Liability

To the maximum extent permitted by law, Boon Band shall not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Security breaches or incidents on your WordPress site
  • Damages resulting from use of or inability to use the service
  • Damages resulting from reliance on assessment results or recommendations

Our total liability for any claims arising from your use of BoonRisk shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if you haven't paid us anything).

8. Indemnification

You agree to indemnify and hold harmless Boon Band and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

  • Your use of BoonRisk
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any security incidents on sites you assess using BoonRisk

9. Termination

We may terminate or suspend your access to BoonRisk immediately, without prior notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the service will cease immediately.

You may stop using BoonRisk at any time. If you used cloud features, you may request deletion of your data by contacting us.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by email or through a prominent notice on our website. Your continued use of BoonRisk after changes become effective constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of BoonRisk shall be resolved in the courts of the United States.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Boon Band regarding BoonRisk and supersede all prior agreements and understandings.
